Terms & Conditions
Last updated: August 2026 — South Africa
1. About these terms
These terms govern your use of this website and any pilot or early-access participation with BEN AIAH (PTY) LTD, a company registered in South Africa (CIPC registration number 202671237207) and based in Johannesburg. They are governed by South African law, and the South African courts have jurisdiction. By using the site you accept these terms.
2. Early-access status
BENAIAH is an early-stage product that is still being built. Features described on this website may be in development, planned, or demonstrated using sample data. Nothing on this website is a warranty that a specific capability exists, will be built, or will perform in a particular way. Where a demonstration is shown, it is labelled as such.
3. Demonstrations and sample data
The Command Center demonstration, the demo assistant, and any figures shown on this website are illustrative and generated from sample project data. They are not results achieved by customers and must not be relied upon as performance claims, benchmarks, or projections.
4. No professional advice
BENAIAH provides software assistance for organising and monitoring project information. It does not provide engineering, quantity surveying, legal, contractual or financial advice, and its outputs are drafts for human review. Responsibility for decisions, instructions, approvals and professional judgement remains entirely with you and your team.
5. Pilot engagements
Participation in the founding pilot programme is by agreement and is subject to a separate written engagement setting out scope, duration, responsibilities, commercial terms and data handling. Submitting an application creates no obligation on either party. Nothing on this website constitutes an offer capable of acceptance.
6. Your responsibilities
You confirm that any information you submit is accurate, that you are entitled to share it, and that you will not submit unlawful, infringing or confidential third-party material without authority. You may not attempt to disrupt, reverse-engineer or gain unauthorised access to this website or our systems.
7. Intellectual property
The website, the BENAIAH name, and all software, designs and content on it belong to us or our licensors and may not be copied, republished or used commercially without written permission. Project information you provide remains yours; a pilot agreement sets out the licence we need to operate the service for you.
8. Availability and links
We aim to keep this website available but do not guarantee uninterrupted access, and we may change or withdraw content at any time. Third-party links (including WhatsApp and social platforms) are provided for convenience; we are not responsible for their content or practices.
9. Liability
To the maximum extent permitted by South African law, including the Consumer Protection Act where it applies, we are not liable for indirect or consequential loss arising from use of this website or reliance on demonstration content. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Changes and contact
We may update these terms as the product develops; the current version is always published here. Questions about these terms: hello@benaiahai.com.
